Saint Arnold Required to Shut Down Beer Garden & Restaurant as State of Texas/TABC is Including All Beer Sales to Distributors in its Calculation as to Whether it is a Bar or Restaurant

Essentially, all beer sold to the distributor and destined for stores, restaurants, etc. is being counted in determining whether the Beer Garden & Restaurant is a bar or restaurant. This seems to be an absurd conclusion for the TABC to reach, as it’s abundantly clear to anyone who has been there that the Beer Garden & Restaurant operates separately from the Brewery itself. This determination could lead to the loss of dozens of jobs.

I’m not here to debate whether allowing restaurants to even be open now is a good idea, but the fact that they are making this determination in this manner seems absurd and fundamentally unfair, if other restaurants are permitted to be open.

The only explanation that I can think of is that the Beer Garden & Restaurant is not considered a separate legal entity from the brewery, and since TABC determines this by the permit holder, if the permit holder for the restaurant is the same legal entity as the brewery that could be the reason.
