Post Car Accident
I was sitting at a red light in heavy rush hour traffic when I was suddenly hit from behind so hard that I was pushed the vehicle in front of me. There was no screech of brakes or anything & the driver said on video (the driver in front of me recorded it), "It was because of my cell phone. You know how it is." I got his insurance info (we both have Progressive) & while the cops didn't show up, I filed a police report a few days later.
After 2 weeks and a recorded call in which a Progressive agent told me that all expenses were being pushed onto the policy of the driver behind us, I get told that the claim is being denied and he couldn't tell me why. I asked if there were any other steps I could take or an appeals procedure and he said, "No." He said he couldn't tell me anything about the denial since it wasn't my policy.
My car was returned to me marked 'TOTAL' and though I did nothing wrong and was at a dead stop when I was plowed into from behind at a red light, I don't know how to proceed. I can't believe I have no further recourse, but I contacted an attorney who said that it was strange that the carrier didn't give me a reason, but they can't do anything until I receive the denial letter from the carrier.
Though my car is a 2009 Impala, it was in close to mint condition and the cabin is perfect, but I don't know what to do with it now. I'm going to wait for the official denial, but assuming there's nothing more I can do, but I need to know what to do with it. I can still drive it, but it's in bad shape. Any ideas as to what the best approach is?
