Judge ruled in favor OF THE SQUATTERS! I’m losing my mind!
So I had left a home vacant for a couple years and some people were scammed (by a guy I'm pressing charges against, as well as the person I'm evicting) because he didn't have the title to the home. I own the home and never gave this dude any authority to sell it. Well, the woman who bought it gave him a $10k "deposit" using Cashapp. She's really naive and thought somehow that was legit. She was paying this scam artist for almost 2 years until I found her living in my home.
When I found her in there we did some checking and realized she'd been scammed. I felt bad and said she could live there for a month to figure things out rent free, then either sign a lease with me or move out. She agreed, until it was time to pay the lease. Then she ghosted me and said she didn't know who to trust.
No biggie, I file eviction in August and we go to court in September. In September I win, but the judge gave her an extremely low appeal bond of $500. So she appeals and I don't get her back in court until early December. Her lawyer stalls again, says he needs to get a witness, the lenient judge gives her 10 days. So now it's been 4 months she has been there for free, we go to court, and guess what? The judge decides for the defendant! I ask my lawyer if that means she owns the house and he says, 1- he'es never seen this, 2- no she doesn't own it, I'm still responsible for making payments but I can't evict her.
WHAT THE F**K!? I'm losing my damn mind now. Ok, there are so more details to the story, the 2 years I wasn't in the house, I was in prison. Her lawyer used this to her advantage to make it seem like I'm somehow a scammer, but I was in prison for a DUI car accident (I know, I fucked up, we can talk about that another day. I already did my prison time over that.) My lawyer says he's going to look into options for an appeal, but right now I'm losing my s**t and have very little confidence in him. I'm thinking of just paying someone to demolish my house since I technically own it. F**k, I don't know how this can happen. Anyone with similar experience? This judge's name is Miryea Ayala.
