If a building gate causing damage to private property shouldn’t HOA be liable?

Building gate does not stop to close even if a car is stopped right on the gate’s path and caused damage, HOA say our private property are not liable to them, but the cause of the damage was the gate which belongs to HOA, is that really possible they can get out of this? Doesn’t make sense to me if they are the one who maintained the gate and the gate failed to sense a car was in the path that should mean the sensor is not working properly and the liability falls to HOA.

Funny thing is I said no difference than if a little girl sitting on the direct path of the gate and the gate closed upon her there’s no way HOA can get away this, Their response was the parent will be liable, not the gate.
