Car shop in Webster scamming me
So here is a fun story that is happening to me. In December 2021 I dropped off a Honda Accord with frontal damage to "Vilchi's Auto" in Webster. The owner at the time quoted me $4,000 total for the car and asked for $2,000 deposit to procure parts. I know it was a bad idea to offer money up front to a shop, and now I have learned that lesson.
Anyways – over the last 7 months the owner, Mario, has constantly delayed and said they need to get one last part, or that the parts are hard to find, or that he can't find the part. And then it was that there were other cars in line to be fixed first. I've driven to his shop in person 3 or 4 times and each time he will come out and just repeat the same stuff, that he should have it ready in a few weeks etc.
I'm basically getting scammed. This week I decided enough was enough, and I contacted him telling him I intended to charge back the $2000 on the credit card and come retrieve the vehicle. He called me irate, defensive and combative and said I wasn't getting a dollar back and that he had bought all the parts.
I said, make a list of the parts and their values, if they are fair prices we can subtract that from the total, and to please provide the parts to me when I come to pick up the vehicle. I figured that was fair and we could go our seperate ways.
He told me it would AGAIN be at least two weeks (its always "two weeks" with this guy) and that I simply couldn't come get my car before he let me know that it was okay. So now he is holding my car, saying I can't get it (despite no work being done to it), holding my money and giving me no timeframe to come get my car. Its a total disaster! I called the Webster Police and they told me to basically get lost, that despite the fact that this guy was refusing my car to me that it wasn't theft. They said I had to sue him to get my car back. This is quite literally beginning to financally ruin me. I went from paying down debt and beginning to put back savings to a total flip, no savings now, and credit card debt racking up not to mention the insane amount of times I have had to bum rides for work and such. I haven't had my car in 8 months!!!
So my question to you guys here is.. does anyone know a good affordable civil matters attorney? I need help to get this thing resolved 🙁
