Can someone who has overstayed their tourist visa apply for a state ID or driver’s permit?

Seems like online it says you need to have "lawful presence" to get limited-term/temporary ID which she obviously does not since she has overstayed her visa.

Note: this would be my spouse. We are in the process of applying for Adjustment of Status (immigration).
