Are Airbnb pools legal? Summer is almost here and that means short-term rentals with pools will soon crank into high gear. But are those pools legal? Chapter 43 of the City of Houston's code has numerous standards and requirements for pools that are available for public use. But what is the difference between a public pool and a residential one? Section 43-2 defines a "residential pool" as one "that is intended for use by not more than two resident families and their guests". Of course many Airbnb only properties have pools, but they do not have residents – only guests.” If you are living with near an Airbnb or STR with a pool, “please consider calling the City's Health Department at 832-405-5392 to report an unlicensed pool being rented to the public. When doing so, please be prepared to provide (i) the address where the pool is located, (ii) the owner's name, (iii) a copy of or link to the rental's on-line ad, and (iv) a copy of the property's appraisal district record.
