Advice after accident in houston
Hello,
so im a veteran of the Houston Road Wars. Ive served over a decade surviving these roads and have only been hit by people 4 time within those ~12 years.
Over those years i had learned life lessons after each person hit me. Gaining XP with each shitty incident that happened.
So this was my 5th time being hit, i was prepared for this shitty situation. Dash cam captured the entire thing.
Cop recorded it on his body cam and also put it in his report (kept the dude who hit me back i hope for a ticket at least).
Now the issue – I drove my car back home because i was 30 seconds from home. It was dark in an underpass and i thought i only had body damage.
Now when i got home i heard my car making noises from the wheel – upon inspection my rear right wheel took a hit also. So my car is undriveable.
I recorded my information and the incident with his insurance on Monday morning (and notified my insurance of the incident).
His insurance said they would call me in 24 hours.
So i tried to get my car looked at to see if its road worthy – but my garage said they wont touch it until the insurance is issued.
I chased up his insurance on monday, tuesday, and today (wed) – and finally on the 6th time was told that they wont talk to me until they have talked to their client who they are unable to get a hold of, and they have 10 days for this process (understandable – however just tell me this on Monday).
Now, i go back to my insurance and they tell me i have rental coverage but it will only trigger if i claim the entire accident on mine.
They told me i could rent a car of similar size to my damaged vehicle and keep the receipts and to request the money back from their insurance once fault has been agreed.
Is this true? what if they refuse my rental charges because they don't agree for any reason?
Do i have any other options?
What is the normal thing to do in this situation?
(Also, Houston accident lesson learned #5: Do not let the guy who hit you know you have a dash cam. He would have spoke to his insurance by now and tried to lie his way out. Now he is avoiding making a statement which is delaying everything by up to 10 days before they proceed without him).
