Restaurant charging different totals for "cash" and "cashless" payment methods.

Edit: I've learned something new. Thanks for the useful feedback, everyone. It is legal for businesses to do this, even if most of all other establishments will take the loss for card payments.

I'm just wondering what are the legalities of charging two different totals based on method of payment in Harris County.

The menu price of an item is $11.99, with tax it totals $12.98, but on their register if the method of payment is "cashless", the total bumps up to $13.50.

Is it legal for this restaurant to do this?

The receipt isn't itemized either, it only lists a "sub-total" of $13.50 – no gratuity, or transaction fee. No signage to indicate any "cashless fee" either.
