Neighbors in apartment complex running illicit Airbnbs — don’t feel safe. Grounds to break the lease?
My upstairs neighbors have been ridiculously loud ever since I moved into this apartment complex. Granted it is an older building with thin walls, but for weeks I kept on hearing people upstairs at 3-4 am, and it sounded like they were moving in? I have been over there thrice to ask them politely to keep it down, only to be greeted with a new tenant every time. Felt like I was being gaslit by the universe that I couldn’t figure out just who lived there, that I had gone to the wrong apartment on accident, or that my legal blindness was getting the better of me. Today a man I had never seen at this complex came to my unit, and short of threatening me, asked me not to disturb his “guests.” He gave me his number and asked to call him directly if I experienced any disturbances. Moreover, he proceeded to tell me that my dog’s barking was bothering the entire complex, and that nobody was making a big deal of that, so I shouldn’t be making a big deal of reasonable noise from upstairs either. He tried to make me feel guilty by telling me that his friends were evacuating from New Orleans, which it turns out they were. However, I’ve spoken to them and while they are in fact his Airbnb guests, they are not his friends; it’s a family of five in a one bedroom unit. When I asked this person, who came over to my house, if he lived upstairs, he answered affirmatively. As a side note, I’d say my service dog is a below average barker, and rarely, if ever, barks late at night. I can’t believe it took me so long to figure out that said person was running an Airbnb without the landlord’s permission, and so is the person next door. The landlord now knows, and both Airbnb listings have been promptly taken down. This is the same property where someone pulled a gun on me. I seriously cannot live here. I have already found another apartment to move to. I just want to recover my security deposit somehow and my rent for September. Once I move into my new apartment, I can look into getting an attorney. Are these unrealistic goals? Is this a legal battle I can possibly win? I do not feel safe living here, nor does an adjacent neighbor of mine. Has anybody had similar experiences? Maybe this is more of a rant rather than a post for advice — I’m sorry. My anxiety is killing me, and I need to let this out.
Tldr: found out that the insane noise levels in my complex are because two separate people are running illicit Airbnb listings.
